The Athar that says Marriage is enslavement

حدثنا محمد، ثنا محمد بن معاوية، قال: نا ابن لهيعة، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بن نوفل، عن عروة بن الزبير قال: قالت لنا أسماء بنت أبي بكر: يا بَنِيَّ وبَني بَنِيَّ، إن هذا النكاح رِقّ،فلينظر أحدكم عند من يُرِقّ كريمته .

Asma bint Abi Bakr (a woman btw) said “ Oh my children and grand children (or son and son of son); Marriage is slavery, so be careful with regard to whom you give your daughter for enslavement.”

[Ref: Sunan sa`eed ibn Mansoor ( Printed version 1/149 ; H: 591 ) with the tahkeeq of shaykh al-`Adhami. Imam ibn Taymiyyah attributed this to `umar ibn al-Khattab as well in Fatawa al-Kubra (3/148); Al-Bayhaqi narrated this as well in his Sunan al-Kubra 7/82 and said that this is also narrated marfoo`an but mawqoof is the one that is correct] 

The prophet (sallalahu `alayhi wa sallam) said : 

اسْتَوْصُوا بِالنِّسَاءِ خَيْرًا ، فَإِنَّمَا هُنَّ عَوَانٍ عِنْدَكُمْ – أي : أسيرات- )

 “I urge you to treat women well, for they are prisoners with you.”

Some Lessons we learn from such narrations




1) A wife is not equal to the husband in a variety of rights that Islam gives to the man. 

2) The prophet and his companions - males and females - have always encouraged people to treat their women folk and family members with love , respect and in the high standard which our own prophet followed.  [See the prophetic standard :  http://the-finalrevelation.blogspot.com/2012/08/how-the-prophet-treated-his-wives.html ]

3) this shows that the husband's rights over his wife does not restrict to inside household but also outside house hold activities. As this narration along with others have been taken by many scholars such as 

Ibn Muflih al-Hanbali (Ref: Adab as-shar`iah 3/375) and Ibn Taymiyyah (in Fatawa al-Kubra quoted above) and others to show that the wife cannot even go out of her house without informing or taking the consent of her husband. This may be backwardness as per the modern day atheists european standards but this very european and american soil , not long ago - a few decades  - followed the same pattern , culture and so much so that suppressed their women and wives from selling them in public to not giving any inheritance which islam is free from. 

4) Allah created every human being differently and likewise genders differently. We cannot treat a man like a donkey and a donkey like a man and likewise a man like a woman and a woman like a man. This is why when we see a woman being pushed down or yelled at we intervene because this is against the manners we opt towards women or at the very least odd because women due to their genders deserve a special behavior towards them (as our prophet specified this) which includes a variety of dealings.. 

5) This is termed as sexism or anti women rights in the west, but this is merely their perspective. A husband wanting to know where his wife goes and why , is not sexism. It is how allah has designed them and behaving naturally is what retains human species for who they are. Forcefully Modifying the natural human traits into robotic cultures or standards takes away the natural fitrah of humans and replaces it with an atheist robotic secular made in 21st century standards
